Rules on registration and industrial trials and registration of pesticides have been introduced in the Republic of Kazakhstan (approved by Order of the Minister of Agriculture of the Republic of Kazakhstan from January 30, 2015 № 4-4/614)
New Rules on registration and industrial trials and registration of pesticides (hereinafter – new Rules) have been approved by Order of the Minister of Agriculture of the Republic of Kazakhstan from January 30, 2015 № 4-4/614. Ministry of Agriculture of the Republic of Kazakhstan has not officially proclaimed and adopted new Rules; however, in the near future these new pending Rules will be officially adopted and will enter into force. New Rules introduce certain amendments to the registration process. The most significant amendments are provided below:
- Current Rules (para. 39) determine November 30 as an application deadline for submission of dossier and the registrant (applicant) has the right to submit missing documents to complete dossier within 60 days. On the contrary, new Rules do not set forth application deadline (para. 37). In addition, new Rules require complete full dossier, which the authorized office of State Plant Protection Agency checks within 2 days. In the situation when the registrant submits not complete dossier the authorized office of State Plant Protection Agency issues motivated refusal of further application consideration.
- Para. 50 of current Rules sets out that in case of suspense of state registration of pesticide the authorized office of State Plant Protection Agency provides the registrant with notification to replace submitted documents or to add new documents to complete dossier within 60-day time-limit. However, according to new Rules the registrant may replace or add new documents to dossier within not 60 days, but 30 days (para. 48 of new Rules). Replacement or adding documents to dossier is required and occurs due to non-compliance of early stated in the dossier physical-chemical, toxicological and other characteristics of pesticide.
- According to current Rules (para. 55) in case of change of producer when the manufacturing technology and formulation composition of pesticide and A.I. are identical, the registrant shall inform in written the authorized office of State Plant Protection Agency and respectively submit relevant documents. At the same time, duration of state registration is maintained, new registration and industrial trials are not required, and the registration continues holding the same state registration certificate. Conversely, according to new Rules in the situation mentioned above the registrant shall inform the authorized office of State Plant Protection Agency within 30-day time-limit prior to the further import of pesticide on the territory of the Republic of Kazakhstan submitting relevant documents. Moreover, early issued state registration certificate shall be annulated and replaced with the new one; new registration and industrial trials are not required, though.
- According to para. 58 of current Rules application for re-registration and its supporting documents shall be submitted 60 days before the termination of the state registration. However, new Rules do not set forth concrete deadline for submission of application and supporting documents for re-registration. In particular, para. 55 determines that the registrant shall submit application and supporting documents to the authorized office of State Plant Protection Agency prior to termination of the registration. At the same time para. 55 indicates that the authorized office of State Plant Protection Agency considers an application and makes a decision within 22 working days from the date of receiving an application.
